Here are the terms and conditions that apply to the University of California’s Fiat Lux survey promotion (the “Promotion”).

The sponsor of this Promotion is the University of California, Office of the President, 1111 Franklin St, Oakland, CA 94607. You understand that you are providing your information to the University of California.

By entering the Promotion, these terms and conditions apply to your entry. Participation in this Promotion constitutes acceptance of these terms and conditions. These terms and conditions may change from time to time without notice.

To participate in the Promotion, you must submit your response to our survey, which is being conducted through Survey Gizmo, between October 9, 2019 at 5:00 a.m. Pacific time and October 25, 2019 at 11:59 p.m. Pacific time (“Promotion Period”).

These terms and conditions are governed by the laws of the State of California. The laws in some places don’t allow the University of California to run this Promotion, in which case the Promotion and these terms and conditions are void in those places. If you are under 18, you must have permission from your parents or legal guardian to enter.

No purchase is necessary to enter or win.

Your entry is received at the time Survey Gizmo registers your response. Incomplete and invalid entries will not be accepted. Only one response per email willl be counted, and the response counted will be the first completed submission. The University of California assumes no responsibility for errors that may occur in the transmission of the entrant’s survey.

The random drawing of 10 winners of University of California tote bags will take place on October 28, 2019 at the University of California, Office of the President office at 1111 Franklin St, Oakland CA 94607 (or at another location determined by the University of California). Survey entries will each be assigned a number based on the order in which they were received in Survey Gizmo (i.e., the first survey entry to come in will be No. 1, the second survey entry to come in will be No. 2, etc.). Winners will be randomly selected using Google’s random number generator. The results are final.

You agree that your entry is your own work. You also agree that your entry will not violate the privacy rights (or similar rights) of others. By entering the Promotion, you grant the University of California a worldwide, non-exclusive, royalty-free license in perpetuity (or at least for the duration of the applicable copyright) to reproduce, publish, adapt, communicate, publicly display, distribute, and broadcast all or part of your entry in any media in connection with this Promotion. On submission, you also consent to us editing, re-using, storing, and communicating your entry in any medium.

The University of California reserves the right to disqualify any entrant who has engaged in: unlawful or improper conduct, conduct designed to jeopardize the fair conduct of the Promotion, conduct generally damaging to the reputation of the University of California, or any breach of these terms and conditions (as determined in the University of California’s sole discretion). The University of California may determine, in its sole discretion, if an entry is suitable and may disqualify any entrant who submits content it deems to be objectionable or offensive (even though such content might not be offensive to everyone). The University of California is not responsible for any fraud, intellectual property infringement, or other misconduct on the part of the entrants. Should an entrant engage in fraud, infringement, or other misconduct of any nature, including but not limited to a violation of the official rules, such entrant shall be subject to immediate disqualification upon discovery of such misconduct. The University of California reserves the right to terminate, modify, or amend the Promotion at any time if the fairness, integrity, and/or proper administration of the Promotion is jeopardized.

The University of California has the right to extend the dates of the Promotion, and we’ll provide notice if we do extend the dates. The University of California can also cancel or modify the Promotion if there are technical or administrative reasons beyond our reasonable control.

The 10 winning entries, as determined by the random drawing, will receive University of California tote bags. Total prize value is USD $8.25. This prize value is accurate as of the start of the Promotion.

Each entrant is responsible for monitoring their email for notification or other communications related to this Promotion. On Monday, October 28, 2019, we’ll start notifying the winners by sending an email to each winner from the webeditor@ucop.edu email account. The winners must respond and claim their prizes by emailing us at webeditor@ucop.edu within two weeks of our notification, or we’ll pick another winner on the following Monday. We’ll ask for any details required for the prize with the winner by email.

If you’d like to find out who won, send an email to webeditor@ucop.edu and include the name of the Promotion within three months of the closing date of the Promotion.

If you win, we may ask you to provide proof of identity, residency, and age. If you can’t provide, or refuse to provide suitable proof, then you may be disqualified, and we may choose another winner.

The University of California may use any personal information contained in your entry or submitted to us in connection with this Promotion and awarding the prize.

You can’t exchange the prize for cash from the University of California, and the prize is non-transferable. We’ll use reasonable efforts to award the prize as described but if we are unable to do that, we may substitute another prize of comparable value.

You’ll be responsible for all taxes, insurance and any other expenses, fees, and costs connected with that prize that are not included in the prize description.

You’re also responsible for your use of the prize, including complying with any applicable terms and conditions of use, including any applicable conditions along with complying with all relevant laws, rules, and regulations.

The University of California is not responsible for use of the prize that results in:

(a) loss that was not reasonably foreseeable;
(b) loss that was not caused by our negligence;
(c) business losses or loss suffered by non-consumers;
(d) losses caused by factors that could reasonably be considered to be outside our control; and
(e) any loss caused, or contributed to, by your breach of conditions of entry or your negligence.

By participating in this Promotion, you agree to release, forever discharge, and agree to hold harmless The Regents of the University of California and its officers, agents, contractors, and employees from any and all claims and demands arising from your entry or participation in this Promotion — including but not limited to claims for violation of rights of publicity, invasion of privacy, libel, defamation, copyright infringement, or trademark infringement.
